Terms & Conditions of Use for iStone

Welcome to iStone, a platform dedicated to facilitating the buying and selling of pre-owned graphics cards (GPUs) and network interface cards (NICs) ("Goods"). These Terms & Conditions ("Terms") govern your access to and use of our website services, and transactions ("Services"). By accessing or using the Site or participating in any transaction through iStone, you agree to be bound by these Terms. If you do not agree, please do not use the Site or engage in transactions.

1. Scope & Definitions

1.1 Scope

These Terms apply to all users of the Site, including:

Buyers: Users purchasing Goods.
Sellers: Users listing or selling Goods.
Visitors: Users browsing the Site without transacting.

The Services are available globally, subject to local laws restricting the sale/purchase of used electronics (e.g., export controls, prohibited items).

1.2 Key Definitions

Goods: Pre-owned graphics cards, network interface cards, and related accessories listed for sale on the Site.
Account: A user profile created via registration (email/phone + password) to access buyer/seller features.
Transaction: A purchase agreement between a Buyer and Seller for Goods, facilitated through the Site.
Listing: A Seller’s description of Goods, including details (condition, specs, price, etc.).
Dispute: A conflict arising from a Transaction (e.g., non-delivery, misrepresentation).

2. Service Description

iStone operates as a third-party marketplace, not a direct seller or buyer. We provide:

A platform to list, discover, and negotiate Goods.
Tools to manage Transactions (e.g., messaging, order tracking).
Basic verification of user identities (via email/phone) to reduce fraud.

iStone does not:

Take ownership of Goods.
Handle payment processing (unless using iStone’s optional escrow service; see Section 4.2).
Guarantee the condition, functionality, or authenticity of Goods (this is the sole responsibility of Buyers and Sellers).

3. User Obligations

3.1 Account Registration & Security

You must provide accurate, up-to-date information (name, contact details) to register.
You are responsible for maintaining the confidentiality of your Account credentials and for all activities under your Account.
Sharing Accounts or using others’ credentials is prohibited. Notify iStone immediately of unauthorized use.

3.2 Seller Responsibilities

Accurate Listings: Sellers must describe Goods truthfully, including condition, specifications, defects, and proof of functionality (recommended).
Prohibited Goods: Sellers may not list stolen, counterfeit, or illegally imported Goods, or those with security risks.
Delivery: Sellers must ship Goods within [X] business days of confirmed payment and provide tracking.

3.3 Buyer Responsibilities

Buyers must pay for Goods within [X] business days of confirming a Listing.
Buyers must inspect Goods upon delivery and report issues within [7] calendar days of receipt.

4. Transactions & Payment

4.1 Pricing & Fees

Sellers set their own prices. iStone may charge a transaction fee (e.g., 5–10%) shown at checkout. Fees are non-refundable once completed.

4.2 Payment Methods

Payments are made directly via bank transfer, PayPal, or credit/debit card.
Optional Escrow: For high-value transactions (> $[X]), iStone may hold payment until buyer confirms receipt. A [X]% escrow fee applies.

4.3 Refunds & Returns

General Rule: Second-hand Goods are sold "as-is" unless stated otherwise.
Exceptions: Returns allowed if Goods differ materially from listing or are non-functional.
Process: Disputes must be escalated via iStone’s support portal. iStone will mediate.

5. Intellectual Property

iStone’s IP: All content on the Site is owned by iStone or licensors. No reproduction without consent.
User-Generated Content: Users retain ownership but grant iStone a license to use/display for operations.

6. Privacy & Data

Your use of the Site is governed by our Privacy Policy, which explains how we collect, use, and share your data. By using the Site, you consent to these practices.

7. Liability & Disclaimers

"As-Is" Basis: Goods are sold without warranties. Sellers are not liable for indirect damages.
iStone’s Limited Liability: Not a party to Transactions, disclaims liability for contract breaches, shipping loss/damage, or listing errors (unless caused by iStone).
Force Majeure: No liability for delays due to events beyond reasonable control.

8. Dispute Resolution

Negotiation: Buyers and Sellers must first attempt resolution directly.
iStone Mediation: Unresolved disputes after [7] days may be submitted to iStone for a binding decision.
Legal Action: If mediation fails, disputes may proceed in the courts of [Jurisdiction].

9. Governing Law & Jurisdiction

These Terms are governed by the laws of [Jurisdiction]. Any disputes will be resolved exclusively in the courts of [Jurisdiction].

10. General Provisions

Modifications: iStone may update Terms at any time. Continued use = acceptance.
